Why do you need competent assistance?

Simply, the Management of Health and Safety at Work Regulations states that employers must appoint competent persons to assist in health and safety either in house and where more complicated situations require a higher level of knowledge and experience outside assistance (e.g. NorthgateArinso Employer Services Health and Safety Support).

Regardless of whether you are self-employed or employ fewer than five employees, you still have to have a health and safety policy and risk assessments in place. However, when you employ five or more employees then you must have the policy and risk assessments documented to comply with the Health and Safety at Work Act and any other associated health and safety legislation.

The importance of complying with health and safety legislation

Health and safety statistics produced by the Health and Safety Executive (HSE) key annual figures for 2008/09

  • 1.2 million people who worked during the last year were suffering from an illness (long standing as well as new cases) they believed was caused or made worse by their current or past work. 551 000 of these were new cases.
  • 180 workers were killed at work,
  • 131 895 other injuries to employees were reported under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR),
  • 246 000 reportable injuries occurred,
  • 29.3 million days were lost overall, 24.6 million due to work-related ill health and 4.7 million due to workplace injury.

It is feasible to assume that one or more of your employees could be part of the above statistics.  If you have suffered an accident as an employer, you will know that once it goes wrong it really goes wrong.  It is at that stage you have to prove to your Enforcing Authority (HSE or your local council’s Environmental Health department) and  your Insurers that you have complied with health and safety legislation and have rigorous documentation in place to prove you have done what would be deemed reasonable.  Non-compliance with health and safety legislation detailed within the health and safety at work act could lead to:
